Lesson 4: Understanding Legal Aspects and Scam

(b) Copyright, Spam and Scam

Copyright issues

When someone creates something, it's his/her property. The law takes care of the protection of the author's right to obtain commercial benefit from his/her valuable work, and of the author's general right to control how a work is used. This is applicable in most of the countries.

To put it simple, you must not copy (and/or reproduce) any work of others, without taking written permission from the owner - even if the material has no commercial value (i.e. if the author has been distributing it free-of-cost) and even if there is no mention about copyright.

Most people don't understand how serious this issue is! Copying someone's creation is like stealing his/her property. It is a criminal offense (and also a civil offense).

You may want to know the consequence of violating (or infringement of) copyright. In the past people have ended up paying millions of dollars for such violation. Instead, it is better to pay and use the product or spend some time and energy to create it on your own.

The article at http://www.templetons.com/brad/copymyths.html provides a lot of information about copyright. If the subject is interesting to you, search Google for more information.

What is SPAM?

Spam is any kind of online communication, which is sent anonymously to many people (bulk), and is unsolicited by the person who received it.

The most common form of spam is e-mail and social networking spam. Some spam is annoying but harmless. However, some spam is part of an identity theft scam (also known as phishing) or another kind of fraud.

Wikipedia explains Spam in terms of Electronic and Spam in terms of Email.

What is not spam?

However, all "unsolicitied emails" are not spam. The term spam is misunderstood many times.

A legitimate commercial proposition, a charity appeal, an invitation addressed personally to someone or to a mailing list can be defined as unsolicited mail, but is not a spam.

For example, you may want to buy or sell a product and you find a website (of a company) that may be your prospect. You take note of the contact person and the email address. Then you contact the person through email. This may be unsolicited by the person, but not a spam. But to make it legitimate, you must provide the reference and address the recipient personally.

Legitimate messages may also include delivery failure messages, misdirected messages, messages from system administrators or even messages from old friends who have previously not corresponded with the recipient by email. Though, such emails are unsolicited, they are not unwanted.

The consequence

It is true, spammers might get a few sales (otherwise why would they spam?). But in the long they might lose their business and in addition they might have to face legal disputes. Off-late people are taking up spam issues very seriously. This is true in India also.

When someone is found spamming, the email service providers (like Gmail, Yahoo) will first blacklist the email ids (of spammers) and they would warn the webmaster of the website from where the emails originate from. If the spamming still continues, the IP address from where the email ids are originating (and the website name) will be blacklisted. The process need not be the same all the time. They may straghtaway blacklist the ip address.

Usually spammers keep changing their email ids and their autoresponder service providers. They cannot afford to use a paid autoresponder service and hence they use free services only. As a result, they lose the trust and reputation.

In short, never ever think about spam - if you want to stay in the business for long.

How not to look like a spammer?

If you are a new internet marketer, there are possibilities that you may spam (or look like a spammer) due to lack of knowledge.

  • Just be professional, do not hunt for customers through email.
  • Have a good website and subscribe to reputed autoresponder service who abide by the law.
  • Get the visitors to your website and ask them subscribe to your email database.
  • But do not pamper your subscribers with an intention to get sales at all costs.
  • Contact them occasionally and gently persuade them to buy your product.

More about autoresponders will be discussed later in one of the chapters.

Various online scams

Apart from online identity theft, there is another kind of scam spread all over the world. This kind of scam has been around even before the internet came to existence and would remain as long as people are greedy and lazy.

This kind of scam involves luring people with an unbelievable offer and extracting money from them. This may involve a product or service in exchange of money. At times this involves money in exchange of money (or a product that promises more money)!

If you apply common sense, you will not become a victim!

I have learnt out of my experience, that "it is impossible to earn money without efforts" and "it is impossible to get something in exchange of nothing".

Next time if you come across a lucrative offer, try to figure out the hidden agenda. Go ahead with the offer, only if you agree to the conditions that are hidden!
